KinBeat Terms of Service

These Terms govern your use of KinBeat. By creating an account or using the KinBeat app, you agree to these Terms. If you do not agree, please do not use the app.

1. Who we are

Kinso Labs Limited ("KinBeat", "we", "us", "our") is a company registered in England and Wales. Registered address: 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. Company number: 17219489. Contact: contact@kinbeat.com.

2. What KinBeat does

KinBeat is a mobile app that helps families watch over an elderly loved one. It looks at gentle signals from the phone (unlocks, volume presses, step count) to understand if the person is using their phone normally. If the phone has been still for a long time, KinBeat asks the person if they are okay. If they do not reply, a family member is notified.

What KinBeat does not do

  • It is not a medical device. It does not diagnose, monitor, or treat any medical condition.
  • It is not a substitute for emergency services. The "I need help" button tries to dial the emergency number, but connection cannot be guaranteed.
  • It is not a substitute for proper care. It does not replace a caregiver, family member, or professional support.
  • It cannot protect against every situation. Phones can run out of battery, lose network, be left behind, or have permissions revoked. KinBeat cannot alert anyone in those cases.

You must not rely on KinBeat alone for the safety of any person.

3. Eligibility

You must be of legal age to enter into a binding contract in your country of residence to use the paid features of KinBeat. In most jurisdictions this is 18, though some allow younger users with a parent's or guardian's agreement.

If you are a minor (under 18 in most places, under 13 everywhere) you must have your parent's or guardian's involvement to use KinBeat. Google Play and Apple's App Store also enforce their own minimum ages at the account level.

4. Your account

  • Provide accurate information (real email, real name) when you sign up.
  • Keep your account secure. Do not share your login details with anyone.
  • You are responsible for activity that happens under your account.
  • One account per person. Do not create multiple accounts or share accounts with others.
  • If you lose access to the email you signed up with, we may not be able to help you recover the account.

5. Acceptable use

When using KinBeat you agree that you will not:

  • Use the app for any unlawful or harmful purpose.
  • Pair with or attempt to monitor someone without their clear knowledge and consent. Monitoring another person without consent may be illegal where you live.
  • Try to access another family's data, bypass pairing, reverse-engineer the app, or attack our servers.
  • Resell, rent, or sub-license your subscription or account.
  • Scrape data, run bots, or otherwise automate use of the app.
  • Upload or share content (such as a nickname) that is abusive, threatening, or infringes on someone's rights.

We may suspend or close your account if you break these rules.

6. Consent for monitoring

If you use the "for someone I care for" role, you must make sure the person whose phone is being monitored has agreed to be monitored. They should understand what KinBeat sees and what it shares with the family. This is especially important for elderly family members - please have a clear, consenting conversation before pairing.

7. Subscription, pricing and cancellation

Free plan

KinBeat has a Free plan that is free forever. It covers 1 elderly person and 1 family member.

Family plan

The Family plan is a paid subscription. It adds more family members, more elderly people to watch over, full settings control, and priority support.

  • Covers 2 elderly parents and up to 10 family members.
  • You can add more elderly parents any time for a small extra monthly fee per added parent.

Until the Family plan goes on sale, some of its features may appear in the app marked "coming soon". Coming-soon features are not part of any purchase and may change before launch.

How pricing works

  • Pricing is shown inside the app in your local currency, based on your app store account country.
  • Prices are set and collected by Google Play or the Apple App Store as our billing partner, depending on your device. Their terms apply to your payment.
  • We may change prices by giving you at least 30 days' notice. If you do not agree, cancel before it takes effect.

Billing cycle

  • Subscriptions renew monthly unless cancelled.
  • Renewal happens automatically at the end of each billing period.
  • Cancel any time via your app store's Subscriptions settings (Google Play or the Apple App Store). Cancellation takes effect at the end of the current billing period - you keep the paid features until then.

Free trial

  • The Family plan comes with a 14-day free trial for new users.
  • After 14 days, if you have not cancelled, the subscription begins and you will be charged as per the plan you picked.
  • If you cancel before the trial ends, you will not be charged.

Refunds

Refunds for subscriptions are handled by the store you purchased through (Google Play or the Apple App Store) and are subject to that store's refund policy. We do not process refunds directly. For refund requests, use the store's help pages or contact us at contact@kinbeat.com and we will try to help.

8. Data and privacy

How we handle your personal data is explained in our Privacy Policy. By using KinBeat you agree to our data practices as described there. You also confirm you have the right to share information about the person whose phone is being monitored, and they have given informed consent.

9. Account deletion

You can delete your account any time from Settings > Delete account.

When you tap Delete, your account enters a 14-day grace period. During these 14 days:

  • You are signed out and the app stops watching.
  • Your data is kept but not shared with family.
  • You can sign in again with the same account to restore everything - no questions asked.

After 14 days, your account and all associated data are permanently removed. This cannot be undone. Some information (such as subscription and payment records) may be kept for longer if we are legally required to do so, for tax and accounting purposes.

You can also ask us to delete your account immediately by emailing contact@kinbeat.com - we'll honour that within 30 days.

10. Service changes and availability

  • We work hard to keep KinBeat available, but we cannot guarantee it will always be up or bug-free. Phones, networks, and third-party services can fail.
  • We may change, add, or remove features from time to time, especially to improve the app or meet legal requirements.
  • We may suspend the service for maintenance, upgrades, or emergencies.
  • We may discontinue KinBeat with reasonable notice. If we do, you can export or delete your data before shutdown.

11. Termination

You can stop using KinBeat at any time - just delete the app or delete your account.

We may suspend or terminate your account if:

  • You break these Terms or our Acceptable Use rules.
  • We are legally required to do so.
  • Your payment method repeatedly fails.
  • You have not signed in for a very long time (we will warn you first).

If we terminate your account for a breach, you will not be refunded for unused subscription time.

12. Limitation of liability

KinBeat is provided "as is" and "as available", without warranties of any kind, to the fullest extent allowed by law.

To the fullest extent allowed by law:

  • We are not liable for indirect, incidental, consequential, or special damages arising out of your use of KinBeat.
  • We are not liable for harm caused by missed alerts, delayed notifications, network failures, battery or permission issues, or phones left behind.
  • Our total liability to you for any claim connected to KinBeat is limited to the amount you paid us in the 12 months before the claim.
  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited under UK law.

13. Intellectual property

The KinBeat name, logo, app, and all related materials are owned by Kinso Labs Limited. Nothing in these Terms transfers any of our intellectual property to you. You get a limited, personal, non-transferable right to use the app while your account is active.

14. Third-party services

KinBeat uses services from Google (Firebase, Google Play Billing, Google Sign-In), Apple (App Store services on iPhone), Brevo (transactional email), and your phone's operating system. Your use of those services is also subject to their own terms. We are not responsible for third-party services, but we choose partners carefully.

15. Governing law and disputes

These Terms are governed by the laws of England and Wales, excluding conflict-of-law rules. Any dispute that we cannot resolve informally will be handled by the courts of England and Wales.

If you live in India, the European Union, or another region, you keep the protections of your local consumer law. Nothing here removes those protections.

16. Changes to these Terms

We may update these Terms from time to time. If the changes are significant, we will tell you by email and inside the app at least 30 days before they take effect. If you keep using KinBeat after the changes take effect, you accept the new Terms. If you do not accept them, you can close your account.

Minor changes (wording, typos, clarifications) may be made without advance notice.
